liability waiver, release & assumption of risk.

01.identity & age confirmation

i confirm that:

• i am the person identified in my matching application and am at least 18 years old
• my photo identification has been visually confirmed by the city captain on the date below
• the information i provided in my matching application is accurate and current

i understand that misrepresentation of identity, age, or matching information is grounds for immediate removal from the program (see § 11 of the matching policy).

02.assumption of risk

i acknowledge that participation in the running dates activities — including but not limited to running, group fitness, organized meetups, and matched 1:1 or group runs — involves known and unknown risks, including but not limited to:

• physical injury (sprains, fractures, muscle strains, falls, collisions with vehicles, pedestrians, cyclists, or other participants)
• cardiovascular events (heart attack, stroke, or other medical emergency, particularly during exertion)
• environmental hazards (weather, road conditions, traffic, wildlife, terrain)
• illness from food, drink, or hydration consumed at meetups
• personal property loss or damage
• conduct of other participants, captains, or third parties not affiliated with the company

i voluntarily and knowingly assume all risks associated with my participation, whether or not such risks are listed above. i represent that i am physically able to participate and have consulted a medical professional if i have any condition that could be affected by physical exertion.

03.release of liability

in consideration of being permitted to participate, i hereby release, waive, discharge, and covenant not to sue:

• the date pac, llc
• its founders, employees, contractors, and authorized representatives
• its city captains and volunteer leaders
• its sponsors, vendors, and venue partners

(collectively, the "released parties") from any and all liability, claims, demands, actions, and causes of action arising out of or related to any loss, damage, or injury — including death — that may be sustained by me, or to any property belonging to me, while participating in any the running dates activity, whether caused by the negligence of the released parties or otherwise, except in the case of gross negligence or willful misconduct.

04.indemnification

i agree to indemnify and hold harmless the released parties from any loss, liability, damage, or cost (including reasonable attorneys' fees) they may incur due to my participation in any the running dates activity, including but not limited to claims by other participants, third parties, or property owners.

05.medical authorization

in the event of a medical emergency during a meetup, i authorize the city captain or any qualified individual present to:

• administer first aid as reasonably necessary
• summon emergency medical services on my behalf
• release my emergency contact information (provided below) to medical responders

i understand that the released parties are not medical professionals and any aid given is in good faith without warranty.

06.photo, video & content release

captains may take photos or video at meetups for community and marketing purposes. participation in any photo or video is voluntary.

leaving the box unchecked means we will not photograph you, or will edit you out of group shots before publication.

07.code of conduct acknowledgment

i have read and agree to abide by the running dates code of conduct (matching policy § 05). specifically, i agree to:

• treat every participant with respect — no harassment, slurs, or unwanted physical contact
• show up sober (no alcohol or drugs at the meetup itself)
• respect the "no" of others — declined matches, declined dates, and declined contact are final
• not solicit, sell, or recruit at meetups
• not photograph other participants without their consent
• not disclose another participant's identity or contact information without their permission

i understand that violating the code of conduct is grounds for removal from the program and forfeiture of any fees, swag, or membership benefits.

08.governing law

this waiver is governed by the laws of the state of california, without regard to conflict-of-laws rules. any dispute arising from this waiver or my participation will be resolved exclusively in the state or federal courts located in los angeles county, california. if any provision is held unenforceable, the remaining provisions remain in full force.

09.severability & entire agreement

this waiver, together with the running dates terms of service, privacy policy, sms terms, and matching participants policy, constitutes the entire agreement between me and the released parties regarding my participation. it supersedes any prior agreements or understandings.
